SUMMER VIBES PHOTO COMPETITION TERMS & CONDITIONS

CONDITIONS OF ENTRY 

1. The Nomad Design Nomad Summer Vibes (“Promotion”) is conducted by Nomad Design, 24 Robertson St, Brendale QLD 4500, Australia, ABN 41 149 800 993 (“Promoter”). 

PARTICIPATION 

1. Entering the Promotion constitutes acceptance of these conditions. 
2. The Promotion is only open to Eligible Entrants. 
3. An "Eligible Entrant" is an individual who is: 
4. Aged 15 years or over; 
5. Not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an employee or other agency related to this promotion; 
6. All relevant instructions on the Promoters’ website (if any) form part of these conditions.  

ENTRY PERIOD 

1. The Promotion commences at 12.00 am Australian Eastern Daylight Time (“AEDT”) on Friday, 1 December 2023 and closes at 11.59 pm AEDT on Thursday, 29 February 2024 (“Entry Period”). 

ENTERING THE PROMOTION 

1. An Eligible Entrant can only enter the Promotion by complying with each of the following requirements of the following entry process:

3. Post your content on Instagram with Nomad Design lure clearly in shot. 
4. Use the hashtag #NomadSummerVibes 
5. Tag @nomadtackle_aus in the photo. 

1. Multiple entries are accepted. 
2. Entrants 

PRIZES 

1. Prizes - $250 prize packs: Two (2) winners per month will be awarded $250 prize packs.  
2. $250 Inshore prize packs: 5 x Squidtrex, 5 x Vertrex, 1 x Nomad cap 
3. $250 Offshore prize pack 4 x Squidtrex, 4 x Vertrex, 1 x Nomad Cap 

1. Nomad Design reserves the right to substitute for any reason whatsoever a Prize (or portion thereof) of comparable or greater value, at their sole discretion.  
2. No Prize substitution or cash equivalent of prize will be awarded for any reason. 
3. The Prize is not transferrable. 
4. By submitting your photo you agree to grant Nomad Design the right to use the image in all media in perpetuity.  

DETERMINATION OF PROMOTION WINNERS 

1. The Promotion is a game of skill, chance plays no part in determining the winner/s and each validly submitted entry will be individually judged by the Promoter and representatives of the Promoter on the basis of suitability. Entries will be judged on the following criteria: 
2.  Photography/Videography quality.  
3. Creativity 
4. Epic fish capture. 

The entry must be an independent creation by the entrant and free of any claims that they infringe any third party rights. 

1. By entering the competition, entrants are agreeing to the competition Terms and Conditions. 
2. All Prize selections will be conducted at Nomad Design, 24 Robertson St, Brendale QLD 4500 Australia. 

WINNER SELECTION DATES 

1. Prize winners will be selected the first Friday of each month 
2. Jan 5 2024 
3. Feb 2 2024 
4. March 1 2024 

• Winner notified via a message on their entry post on Facebook or Instagram,. 

1. The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any individual entrant or group of entrants for tampering with the entry process, or for submitting an entry which is not otherwise in accordance with these conditions of entry. 
2. In the case that the Promoter finds evidence of tampering by the entrant in the entry process or the verification process, in addition to declaring any or all entries made by the entrant invalid, the Promoter may at its complete discretion preclude that entrant from participating in any or all future Promotions of the Promoter. 
3. All Eligible Entrants must ensure that their entries are received by the Promoter during the Entry Period. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information either caused by website users or by any of the equipment or programming associated or utilised in this Promotion, or by any technical error that may occur in the course of administration of this Promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of Entries. 

FORFEITURE AND RETURN OF PRIZES 

1. If an Eligible Entrant breaches their obligations under these Conditions or any agreement with the Promoter, the Promoter may determine that the Eligible Entrant has forfeited their Prize. 

GENERAL 

1. Entrants are required to take full responsibility for the content of their entry and for ensuring that their entry complies with these Terms and Conditions. 
2. If for any reason the conduct or operation of the Promotion is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Promotion. 
3. Promoter’s decision is final and no correspondence will be entered into.  
4. All Winners have 5 days to claim the Prize (includes day of notification).  
5. It is the winner’s responsibility to advise the Promoter of the correct postal address in order for prizes to be posted to. The Promoter takes no responsibility for the prize’s condition once it leaves the premises and is up to the winner to ensure they receive the prize. 
6. The Promoter reserves the right to forfeit the Prize or select a new Winner in the event of any Eligible Entrant not claiming the Prize. 
7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, proof of employment, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. 
8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 
9. Any cost associated with accessing the Promotion website is the entrant’s responsibility and is dependent on the Internet service provider used.
